Welcome to Clovy! These Terms of Service ("Terms") govern your use of our website located at clovy.app and our mobile applications (collectively referred to as the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access or use the Service.
1. User Accounts
To use certain features of Clovy, you must register for an account. By creating an account, you agree to:
- Provide accurate, complete, and current information.
- Safeguard the confidentiality of your account credentials and prevent unauthorized access.
- Notify us immediately at support@clovy.app if you suspect or detect any security breach or unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
2. User Content & Clothes Uploads
Our Service allows you to upload photos of your clothes ("User Content") to build a virtual wardrobe catalog. You retain full ownership of any User Content you upload or submit to Clovy.
By uploading User Content to the Service, you grant Clovy a non-exclusive, worldwide, royalty-free, and secure license to store, process, crop, display, and analyze your photos solely for the purpose of delivering styling services and daily outfit recommendations to you. We do not sell, trade, or distribute your clothing photos to external parties.
You agree not to upload any content that: (i) is illegal, harmful, or offensive; (ii) infringes on any third-party intellectual property or privacy rights; or (iii) contains viruses or malicious code.
3. Subscriptions & In-App Purchases
Certain features of Clovy may require a paid subscription ("Premium Features"). By subscribing, you agree to the following terms:
- Billing: Subscriptions are billed on a recurring basis (e.g., monthly or annually) and are processed securely through Apple App Store or Google Play Store payment systems.
- Automatic Renewal: Your subscription will renew automatically at the end of each billing cycle unless you disable automatic renewal at least 24 hours before the current cycle ends.
- Cancellation: You can manage or cancel your subscription at any time directly through your Apple ID or Google Play Store account settings. Refunds are handled in accordance with the policies of the respective app stores.
- Pricing Changes: We reserve the right to adjust subscription rates at any time. We will provide you with reasonable advance notice of any price changes.
4. Intellectual Property
The Service and its original content (excluding User Content), features, AI algorithms, styling systems, visual design tokens, logos, and branding elements are and will remain the exclusive property of Clovy and its licensors. Our brand names, logos, and trademarks may not be used in connection with any third-party product or service without our prior written consent.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Clovy and its developers, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service.
- Any styling recommendations, wardrobe matching, or weather advice provided by the AI, which are provided for general informational and styling purposes only.
- Any unauthorized access, use, or modification of your uploads or account details.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
6. Termination
We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
Upon termination, your right to use the Service will cease immediately. You can delete your account and all associated wardrobe catalog photos directly within the app settings at any time, which will result in complete data deletion from our production databases.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where the Clovy parent entity is incorporated, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
